A trust can come into existence without any documentation at all, depending on the behavious and representations of the parties involved.  To be certain that a trust has been established, however, it may necessary to bring the matter before a court, with associated additional expense and delay.  In some circumstances an effective alternative is to simply declare that the trust has been in existence for some time and formally recognise that the trust exists and continues by way of deed.
