A review of a discretionary family trust may be required when there are issues with the trust deed such as:

  • inability to separately recognise and deal with different types of income, such as taxable capital gains or franked dividends
  • inappropriate provisions in relation to the passing of control on the death or disability of family members (particularly in an estate planning context)

This discretionary trust strategy review will identify such issues and make recommendations for updating the trust deed where possible and without resettling the trust.
